Conditions of Participation

in FlyToChange programmes

This document sets out the general conditions of participation in FlyToChange training and consulting programmes, so that you can make an informed decision about whether a programme is right for you. The full terms of a specific trip are always agreed individually in a contract signed before you enter into any commitment. This document is informational in nature and does not replace an individual contract or legal advice.

Every FlyToChange programme is individual. Even if a mastermind has the same destination year over year, the prices, facilitators, dates and logistics differ. The conditions below are the framework on the basis of which we agree the details of your specific trip.

Part I

Nature of the programmes

1.1 The three pillars of FlyToChange

FlyToChange provides three categories of service, differing in format and scope:

1.2 Legal classification

FlyToChange programmes are training and consulting services. They are not a package travel arrangement or a linked travel arrangement within the meaning of the Polish Act of 24 November 2017 on package travel and linked travel arrangements. FlyToChange is not subject to the obligation to register in the Central Register of Tour Operators and Travel Agents, nor does it hold the bank guarantee required of tour operators.

The practical consequences: you arrange and pay for the flight to the destination yourself, you take out travel insurance yourself, and the invoice is issued with the description "Participation fee FlyToChange Mastermind Programme" (participation in a training programme), not as a travel package.

1.3 B2B client

The programmes are aimed at entrepreneurs (sole traders, companies). The invoice is issued to the business, in EUR net. Payment for participation constitutes a tax-deductible business expense of the participant.

If you participate as a natural person not conducting business activity (a Consumer), the mandatory provisions of Polish consumer law apply, including the right to withdraw from the contract within 14 days (except where the service has been fully performed with your express consent).

Part II

Contract formation process

2.1 Four stages

Every contract for participation in a programme is formed in four steps:

1. Conversation You fill in the form or write to us. You tell us who you are, why you want this trip and what you do not want. We meet for a conversation (by phone, video or in person).
2. Concept Based on the conversation, we put together a programme proposal. For masterminds, you receive the dates, location, facilitators and price. For journey design, an individual trip proposal.
3. Acceptance If the concept suits you, you sign a participation contract containing the full terms of your trip (price, schedule, cancellation policy, insurance, personal data).
4. Deposit payment Once the deposit (20% of the price) has been paid, your place is reserved. The remaining payments follow the schedule.

2.2 Information on the website is not an offer

Information published on the website www.flytochange.club, including descriptions of programmes, destinations and approximate prices, is informational in nature and does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. The contract is concluded solely through an individual agreement signed by you and us.

Part III

Pricing and payment schedule

3.1 Prices

We set programme prices individually depending on the format, location, facilitators, number of participants and duration. We provide the current price range during the consultation call, before you make a decision.

All prices are quoted in EUR net (excluding VAT). As a company registered outside the European Union, we are not a VAT payer in the EU. A client from Poland who is an entrepreneur accounts for VAT independently under the import of services (the reverse charge mechanism, Article 28b of the VAT Act).

3.2 Standard payment schedule

You make payments by bank transfer, by payment card through the payment provider indicated in the contract, or in another manner agreed with us. The invoice is issued within the period required by Polish tax regulations.

3.3 Individual arrangements

The standard schedule may be adapted to your individual situation by negotiation before the contract is signed. Any changes are recorded in the contract with the specific Client.

Part IV

Cancellation policy

4.1 Cancellation fee schedule

In the event of cancellation of participation in a programme, the following schedule of fees applies:

Cancellation must be made in writing (by email to the FlyToChange address). A refund, where due, is made within 14 days of the cancellation date.

4.2 Transfer of participation

As an alternative to cancellation, we offer the option to transfer participation to another edition of the programme. This is possible at any stage, subject to payment of the difference in price between editions. This solution protects your investment when your life circumstances change but the programme format itself remains important to you.

4.3 Cancellation of the programme by FlyToChange

If the number of registered participants does not reach the minimum (6 by default) by 60 days before for European destinations, or 90 days before for Asian destinations, we reserve the right to cancel the programme. In that case we refund the full amount you have paid within 14 days or, at your choice, propose a transfer to the next edition.

We do not cover the cost of flights, transfers or insurance purchased independently. We recommend that you do not buy flights or other independent services before receiving written confirmation that the programme will take place (which we provide no later than the 60- or 90-day deadline indicated above).

Part V

What is included in the programme price

5.1 Included in the price

  • Accommodation in a carefully selected property
  • Meals as described for the specific edition
  • Local transport during the programme
  • The substantive sessions of the mastermind or the themed programme
  • Discreet photographs documenting the stay, for personal use
  • Edition-specific elements of the programme (e.g. workshops, field sessions, culinary experiences)

5.2 Outside the price (your responsibility)

  • Air transport to the destination and the return flight
  • Travel insurance (details in Part VI)
  • Travel documents (passport, visas)
  • Individual expenses, alcohol, massages, additional excursions

The full list of what is specifically included in the price and what is not is always described in detail in the contract with the specific Client.

Part VI

Insurance and travel documents

6.1 Insurance requirement

Holding valid travel insurance is a condition of participation in the programme. Minimum scope:

  • Medical expenses insurance for a sum of at least EUR 100,000
  • Private third-party liability insurance
  • Personal accident insurance
  • Validity within the territory of the programme destination

You provide us with proof of insurance (the policy number) no later than 14 days before the programme start. The absence of a policy entitles FlyToChange to refuse admission to the programme.

We recommend established insurers from the Polish market (Allianz, Signal Iduna, ERV, TU Europa), but the choice is yours. We also advise that you consider cancellation insurance.

6.2 Travel documents

You are yourself responsible for holding a valid passport (with at least 6 months' validity beyond the return date) and the visas required for the chosen destination. FlyToChange is not liable for refusal of entry due to a lack of the proper documents.

Part VII

Force majeure

7.1 Definition

Force majeure means events beyond the control of the Parties that could not have been foreseen or prevented, in particular:

  • natural disasters (typhoons, earthquakes, tsunamis, floods, volcanic eruptions)
  • pandemics and epidemics
  • acts of terrorism, armed conflicts, political unrest
  • decisions of government authorities (border closures, travel bans, quarantines)
  • infrastructure failures (power or communication outages)
  • strikes in air or public transport

For Asian destinations the list is broader due to regional specifics.

7.2 Procedure

In the event of force majeure, we contact you without undue delay and propose a new programme date or a refund reduced by costs already incurred (deposits to suppliers, non-refundable hotel charges, the cost of contracted facilitators).

Part VIII

Liability

8.1 Scope of FlyToChange's liability

FlyToChange undertakes to deliver the programme with due care. The content delivered during the programme, including statements made by the Facilitators, represents their personal experiences and opinions. It does not constitute business, investment, financial, legal or professional advice. Neither FlyToChange nor the Facilitators are liable for decisions you make on the basis of the programme content.

You take part in the programme at your own risk, including in respect of physical activities. You are liable for damage you cause.

8.2 Liability cap

FlyToChange's liability towards a participant under the contract is limited to three times the fee paid for the programme. This limitation does not cover damage resulting from death, personal injury or wilful conduct on the part of FlyToChange.

8.3 Acts of third parties

FlyToChange is not liable for the acts of external entities, in particular airlines, hotels, transport companies, restaurants and local operators. We select our partners carefully, but their independent actions remain beyond our control.

Part IX

Discretion and group confidentiality

9.1 A mastermind is a circle of trust

The mastermind format is built on complete trust between participants. The content of sessions, the identity of the other participants, their business data (revenue, strategies, financial problems), personal data disclosed during the programme, materials provided by the Facilitators, and any information whose confidential nature follows from the context, are treated as confidential information.

Each participant undertakes to maintain complete discretion regarding the content of the sessions and the identity of the other participants. This obligation remains in force for 5 years from the date of the programme.

9.2 Copyright in the materials

Materials, studies and presentations provided by FlyToChange or the Facilitators are intended solely for the participant's personal use. They may not be copied, made available to third parties, published or used commercially without written consent.

9.3 Recording

Audio or video recording of sessions without the written consent of FlyToChange is prohibited.

9.4 Participant's code of conduct

You undertake to be mentally present during the sessions, to respect the group's discretion, and to treat the other participants and facilitators with respect. FlyToChange reserves the right to exclude from further participation in the programme any participant whose conduct breaches the above rules, the safety of the group or local law. FlyToChange's decision in this matter is final.

Part X

Image rights and marketing materials

10.1 Personal photographs, included in the programme price

As part of the programme, we arrange for discreet photographs documenting your stay and the stay of your companions, intended for personal use. This is a gift for your family, not marketing material.

10.2 Marketing use of your image, only with express consent

The use of your image in FlyToChange marketing materials (website, social media, brochures, presentations) requires separate, express consent given in writing.

The absence of such consent does not limit your right to receive your personal photographs. Discretion is the foundation of FlyToChange. Participants' names are never disclosed externally, unless a particular participant expressly wishes to be publicly associated with the programme.

Part XI

Personal data and its transfer

11.1 General principles

The full rules for processing your personal data are set out in the FlyToChange Privacy Policy. Here we cover only the most important consequences for participation in the programme.

11.2 Programme participant's data

In connection with the delivery of the programme, we process contact data, travel data (first name, surname, date of birth, passport), sensitive data (allergies, mobility limitations, relevant health information, solely with your consent) and financial data (invoice, payment).

11.3 Transfer of data outside the EEA

Most FlyToChange destinations are located in countries outside the European Economic Area for which the European Commission has not issued an adequacy decision (Vietnam, Thailand, Indonesia, including Bali). Acceptance of the participation contract includes your express consent to the transfer of your data to local partners in those countries (Article 49(1)(a) GDPR), to the extent necessary to deliver the programme.

For European masterminds, data transfers take place within the EEA (France, Italy, Greece, Spain, Portugal), where the EU adequacy decision and the GDPR apply directly. Without the risks of transfer outside the EEA.

Part XII

Complaints and dispute resolution

12.1 Complaints

Complaints concerning a programme that has been delivered are submitted in writing to the FlyToChange email address within 30 days of the end of the programme. We respond within 14 calendar days.

12.2 Out-of-court dispute resolution

A Consumer has the right to use out-of-court methods of handling complaints, including mediation conducted by the voivodeship inspector of the Trade Inspection and the European Commission's ODR platform, https://ec.europa.eu/consumers/odr.

12.3 Governing law

The law governing the participation contract is indicated in the individual contract. For Consumers, the mandatory provisions of Polish consumer law always apply.
